How Environmental Hazards Affects Real Estate

Per California environmental law, it is required of all parties who are looking to sell a property to adequately and fully disclose any environmental hazards that are associated with the property – especially should the presence of these hazards have any bearing whatsoever on the value of the premises. These types of hazards can include the presence of asbestos, having lead-based paint on any of the walls or even having formaldehyde present in any of the building materials.

It, however, is important to note that while it is the responsibility of the broker – it is also the responsibility of the buyer to properly and adequately look through the property that they are considering buying to look for such hazards. Even if they do not bring forward issues immediately, it is important that they act quickly as there is typically a two year cap with which they can bring forward an issue with a claim.
